1. Commitment and Scope

Dink&Dash Club (hereinafter referred to as "DDC", "we", "us", or "our") is a sports academy operated by Bright Wide Inc Ltd, having its registered business address at LG01, One Kowloon, 1 Wang Yuen Street, Kowloon Bay, Hong Kong. We deeply respect your personal privacy and are fully committed to complying with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong (the "Ordinance") and its six Data Protection Principles (DPP). This Privacy Policy applies to the official DDC website, the DDC mobile application (the "App"), and all physical and digital sports services provided by DDC.

2. Collection of Personal Data (Personal Information Collection Statement - PICS)

In compliance with Principle 1(3) of the Ordinance, we explicitly inform you of the following collection practices:

2.1. Categories of Data Collected:

  • Mandatory Data: Authentic full English name (which must match your official identity document), contact telephone number, regular email address, account login credentials, and transaction and payment records. If you fail to provide such mandatory data, we will be unable to complete your account registration, process court reservations, transmit urgent safety and severe weather notices, or deliver related services.
  • Minors' Data: Users under the age of 18 must provide personal data only with the consent and under the supervision of their parent or legal guardian.
  • Automatically Collected Data: Device IP address, operating system, browser type, login timestamps, and browsing behavior within the App (utilized solely for system optimization and aggregate statistics, without directly identifying any specific individual).

2.2. Special Notice on Biometric Authentication:

Users may optionally choose to log into the App using iOS Face ID / Touch ID or Android biometric sensors. Such biometric data is stored exclusively within the Trusted Execution Environment of your personal mobile device. DDC never collects, transmits, or stores any of your fingerprint or facial biometric data under any circumstances.

3. Purposes of Personal Data Use

Collected personal data will be utilized strictly for the following lawful operational purposes:

  • Establishing and administering your membership account, and verifying user identity to prevent account misappropriation or fraud;
  • Processing court reservations, group course enrollments, private coaching arrangements, and payment settlements;
  • Implementing booking cancellations, issuing and redeeming 14-day valid stored credit ("Credit"), and issuing expiration and forfeiture notices;
  • Issuing immediate venue closure alerts during severe weather conditions, including Tropical Cyclone Warning Signal No. 8 or Black Rainstorm Warnings;
  • Recovering damages for facility destruction, levying the HK$500 cleaning charge, and handling disputes or disciplinary suspensions;
  • Responding to medical emergencies and complying with regulatory requirements under applicable Hong Kong laws or law enforcement authorities.

4. Direct Marketing Policy

We strictly observe the provisions regarding direct marketing under Part VIA of the Ordinance:

  • 4.1. Explicit Consent Requirement: Without obtaining your express written consent or indication of no objection (Opt-in), we will never use your personal data (name, telephone number, email) for marketing or promotional campaigns.
  • 4.2. Scope of Marketing: Subject to your consent, promotional materials are strictly confined to DDC pickleball courses, training camps, court passes, facility privileges, and charitable sports events.
  • 4.3. Free Unconditional Opt-Out: You may withdraw your consent at any time free of charge. Opt-out methods include: clicking the "Unsubscribe" link within marketing emails, disabling promotional notifications within the App, or emailing [email protected]. Opting out will not affect your standard bookings or member entitlements in any way.

5. Data Disclosure and Transfer (Transferees)

We maintain strict confidentiality over your personal data and will never sell personal information to third parties. We will transfer data only to the following authorized third parties where necessary:

  • Third-party IT contractors providing booking system maintenance, server hosting, cloud storage, and technical support to DDC (bound by strict confidentiality agreements);
  • Third-party electronic payment gateways and banks processing credit card and online financial transactions;
  • Professional advisers, insurance companies, or legal counsel assisting in handling legal disputes, debt recovery, and facility damage claims;
  • Government authorities, law enforcement agencies, or judicial bodies where disclosure is mandated pursuant to statutory subpoenas, court orders, or applicable statutory requirements. All personal data is hosted on secure servers situated within the territory of Hong Kong; we will not transfer your personal data outside of Hong Kong.

6. Data Security and Retention Policy

  • 6.1. Security Safeguards: We employ industry-standard SSL/TLS encrypted transmission, network firewalls, and tiered database access controls to safeguard data against unauthorized access, leakage, tampering, or damage.
  • 6.2. Retention Period: Personal data is retained only for such duration as is necessary to fulfill the purposes of collection. Following account cancellation, other non-essential personal data will be completely erased or permanently anonymized once processing is concluded, except where financial and transaction records must be retained for a prescribed statutory period (generally 7 years) to satisfy tax, accounting, and legal defense requirements under Hong Kong law.

7. Rights of Data Access and Correction

Under Principle 6 of the Ordinance, you are entitled to ascertain whether we hold your personal data and request access to and correction of any inaccurate data.

8. Governing Language

This Privacy Policy is executed in both Traditional Chinese and English versions. In the event of any discrepancy or conflict between the two versions, the English version shall prevail.
