Welcome to Dink&Dash Club (hereinafter referred to as "DDC" or the "Facility"). These Terms and Conditions (hereinafter referred to as these "Terms") are formulated by Bright Wide Inc Ltd (hereinafter referred to as the "Company"). The Facility is located at LG01, One Kowloon, 1 Wang Yuen Street, Kowloon Bay, Hong Kong. By downloading, registering, or logging into our official mobile application (the "App"), completing registration at our on-site self-service kiosks, booking any court facilities, enrolling in classes, or entering the premises of the Facility, you acknowledge that you have read, understood, and unconditionally agreed to be bound by all provisions of these Terms.
1. Definitions and User Registration
1.1. Legal Entity:
DDC is an indoor pickleball venue operated by Bright Wide Inc Ltd.
1.2. Authentic Identity and Age:
All patrons must complete registration via the App or on-site kiosks. The registered name must match the individual's official valid identification document (e.g., Hong Kong Identity Card or Passport) exactly. Individuals under the age of 18 must obtain the consent of their parent or legal guardian, and their guardian must complete App registration and verification on their behalf prior to becoming a user.
1.3. Account Authenticity and Prohibition of Transfer:
Users must provide an authentic, valid mobile phone number and a regularly used email address; the use of virtual mobile numbers is strictly prohibited. User accounts, memberships, purchased items, and booking slots are non-transferable and may not be shared. The Company accepts no liability whatsoever for any unauthorized account usage resulting from a user's failure to safeguard credentials or device theft.
1.4. Account Amendments and Deletion:
Requests to modify account information must be emailed to [email protected] with valid supporting documents. If a user requests account deletion, processing will take up to 40 days; once an account is deleted or terminated due to violations, all stored credit ("Credit"), courses, and bookings within the account will be immediately forfeited without refund.
2. Membership Tiers, Pricing, and Booking Policies
2.1. Membership System and Rates:
Facility bookings are open to all registered users. Entitlements and fees across different membership categories are subject to the pricing structures published by the Facility.
2.2. Payment Confirmation:
All reservations are confirmed only after full payment has been successfully processed through authorized third-party payment gateways supported by the App.
3. Court Cancellation Terms and Credit Refund Policy
3.1. Strict 72-Hour Cancellation Window:
All court booking cancellation requests must be submitted and completed via the App at least seventy-two (72) hours prior to the scheduled booking start time. Any cancellation requested within 72 hours of the start time will not be accepted, and fees paid are non-refundable.
3.2. Credit-Only Refund Policy:
For bookings successfully cancelled in compliance with the 72-hour notice requirement, no cash refunds or reversals to any payment methods will be issued under any circumstances. The Company will refund the eligible amount solely in the form of stored credit ("Credit") credited to the user's App account.
3.3. Credit Validity and Usage Restrictions:
Any Credit issued as a result of a user-initiated cancellation 72 hours in advance is strictly valid for fourteen (14) days from the date of issuance. Unused Credit will automatically expire and become void; the Company will not reissue, extend, or convert Credit to cash under any circumstances.
When a customer books a court slot using refunded Credit, that reservation cannot be cancelled under any circumstances.
3.4. Course and Coaching Cancellations:
Group courses are non-refundable once payment is confirmed. Cancellations due to illness require the submission of a valid medical certificate within 48 hours via the App for review and case-by-case approval by management.
4. Severe Weather and Typhoon Arrangements (Bad Weather & Typhoon Policy)
4.1. Tropical Cyclone Warning Signal No. 8 or Above / Black Rainstorm Warning Signal:
If the Hong Kong Observatory issues a Tropical Cyclone Warning Signal No. 8 (or above) or a Black Rainstorm Warning Signal within 2 hours prior to a scheduled session, or while a session is underway, DDC facilities will close immediately for safety. For affected sessions that have not commenced or are not completed, all paid fees will be refunded in full as stored credit ("Credit") credited to the user's App account (no cash refunds), valid for 14 days. Affected users may also email [email protected] within 48 hours following the weather event for follow-up.
4.2. Lowering of Signals:
When Signal No. 8 or the Black Rainstorm Warning is lowered or cancelled, the Facility will resume operations within approximately 2 hours, subject to safety evaluations.
4.3. Signal No. 3 / Amber or Red Rainstorm Warnings:
As an indoor facility, DDC will generally operate as normal unless management issues an official closure announcement due to public safety concerns. If the venue remains open, standard "72-hour cancellation" terms remain fully applicable.
5. Facility Regulations, Footwear Requirements, and Sanitation
5.1. Capacity Limit (Strictly Maximum 8 Persons Per Court):
To ensure sporting safety and maintain a high-quality experience, each pickleball court is strictly limited to a maximum of eight (8) participants on-court and rotating at any given time. On-site staff reserve the right to immediately remove any individuals exceeding this limit.
5.2. Footwear Safety and "Strictly No Black Soles":
Proper Indoor Court Shoes: To prevent slips, trips, and ankle sprains, all persons entering the court playing perimeter must wear clean indoor-specific athletic court shoes (Indoor Court Shoes) with anti-slip traction. Bare feet, slippers, sandals, leather shoes, high heels, and outdoor hiking shoes are strictly prohibited. Strictly No Black Soles (No Black-Soled Shoes): To preserve professional court flooring and prevent black scuff marks, anyone wearing black soles (Black-soled shoes) or any footwear that leaves marking on the surface is strictly prohibited from entering the courts to play. Staff reserve the right to immediately terminate the court access of non-compliant individuals without compensation, refunds, or rescheduling.
5.3. Food and Drink Restrictions (Plain Water Only):
No food or beverages of any kind are permitted within the court areas (including playing surfaces and player benches), with the sole exception of plain water (Water), unless prior written approval has been granted for an authorized special event.
5.4. HK$500 Cleaning Charge:
If any user leaves litter, spills food or non-water beverages, causes vomit stains, or otherwise soils the premises due to improper behavior, the Company will immediately levy a HK$500 Cleaning and Sanitization Charge on the primary booking holder.
5.5. No-Smoking Policy:
Smoking and the use of electronic cigarettes are strictly prohibited throughout the entire Facility. Violators will be advised to leave immediately or reported to the police for handling.
5.6. Punctual Vacation:
Users must vacate the court immediately upon the expiration of their reserved timeslot. Failure to leave on schedule will result in additional court rental charges.
6. Sports Safety, Personal Liability, Eye Protection Advice, and Damages
6.1. Eye Protection Strongly Advised:
Due to the fast-paced nature of close-quarters rallies in pickleball, the Company strongly recommends that all players wear professional sports protective goggles (Eye Protection Glasses) at all times during play to safeguard against high-speed ball impacts.
6.2. First-Aid Amenities:
Standard first-aid supplies are available on-site for patron use. Please approach on-site staff for assistance if required.
6.3. Health Self-Assessment and Unwellness Guidelines:
Do Not Play When Sick: If feeling unwell with fever, dizziness, or symptoms of communicable illness, patrons are strongly advised against entering the courts to exercise. Cease Play Immediately If Unwell: If you experience dizziness, heart palpitations, chest tightness, or severe physical discomfort during exercise, you must stop playing immediately and notify on-site staff for assistance.
6.4. Assumption of Sports Risks (Disclaimer):
Users acknowledge and agree that pickleball is an intense sport involving inherent risks of physical injury, including sprains, fractures, and traumatic athletic injuries. To the fullest extent permitted by Hong Kong law, the Company (Bright Wide Inc Ltd), its affiliates, directors, and employees exclude all liability under contract, tort, or other causes of action for any personal injury, death, property loss, or damage arising from a user's own negligence, underlying health conditions, or activities within the premises.
6.5. Full Compensation for Property Damage:
Patrons must treat all facility fixtures with care (including nets, posts, divider netting, sports flooring, and lighting). If any facility or equipment is damaged due to willful misconduct, rough handling, or breach of rules, the booking holder and responsible parties shall be held fully liable to compensate the Company for all repair, replacement, administrative, and legal costs.
7. Unauthorized Commercial Activities and Management Authority
7.1. Unauthorized Coaching and Commercial Operations:
Engaging in paid coaching, private commercial events, or tournaments without the prior written consent of the Company is strictly prohibited. Only coaches officially registered and certified with DDC are permitted to conduct coaching within the premises. Violators will be expelled immediately, barred from accessing the Facility for up to 3 months, and the Company reserves the right to pursue legal remedies.
7.2. Photography Restrictions:
Commercial photography or filming is strictly prohibited within the Facility without prior written permission from management. The Company reserves the right to use promotional event photographs for marketing purposes; users who do not wish to be photographed may notify us in advance via email.
